The Legality and Regulation of Betting Apps in Bangladesh

In recent years, the popularity of online betting has surged worldwide, with a significant rise in the use of mobile apps for this purpose. Bangladesh, like many other countries, has witnessed this trend, leading to concerns about the legality and regulation of betting applications within its borders. This article aims to shed light on the current state of affairs regarding betting apps in Bangladesh, examining the legal framework and regulatory measures in place.

Legal Framework in Bangladesh:

Bangladesh has strict laws in place when it comes to gambling. The Public Gambling Act of 1867 prohibits almost all forms of gambling within the country. This includes both physical establishments and online platforms with their betting apps in Bangladesh and other services. The law defines gambling as “the act of playing any game of chance for money or money’s worth.” Therefore, betting applications, which facilitate gambling, fall under the purview of this legislation.

Regulatory Measures

To enforce the prohibition on casinos, the Bangladesh government has taken several steps to curb its prevalence. The Bangladesh Telecommunication Regulatory Commission (BTRC) plays a vital role in regulating the telecommunications sector, including mobile apps. They have actively worked to block access to gambling websites and applications by instructing internet service providers to block these platforms’ IP addresses. This measure aims to prevent users from accessing betting applications within Bangladesh.

Legal Consequences

Engaging in any form of illegal betting, including using betting applications, can result in severe legal consequences in Bangladesh. Those found in violation of the Public Gambling Act of 1867 can face imprisonment for up to three months, fines, or both. Additionally, the government has also imposed penalties on telecommunications companies that fail to comply with the instructions to block gambling websites and apps.

Challenges and Enforcement

Despite the stringent legal framework and regulatory measures, enforcing a complete ban on betting apps presents challenges. The widespread use of virtual private networks (VPNs) allows individuals to bypass the blocks imposed by internet service providers, gaining access to gambling websites and applications. This poses a significant hurdle in effectively implementing the ban.

Furthermore, the rapid advancement of technology makes it challenging for authorities to keep up with the constantly evolving landscape of betting apps. As soon as one app is blocked, new ones can quickly emerge, making it a game of cat and mouse for the regulators.

International Perspective

While Bangladesh takes a firm stance against gambling, it is important to note that the legal and regulatory landscape varies across different countries. Some nations have chosen to legalize and regulate certain forms of gambling, including online betting, as a means of generating revenue and ensuring consumer protection. This diversity in approach highlights the complex nature of the issue and the need for a comprehensive evaluation of the benefits and drawbacks associated with casinos regulation.
